Terms of Service

These terms govern your use of The 50% Club. Please read them carefully — they include important information about AI-generated feedback, subscriptions and your rights.

1.Who we are

The 50% Club ("we", "us", "our") provides an online platform that lets ACCA students practise exam-style questions in a computer-based-exam environment and receive AI-generated, examiner-style feedback and analytics. These Terms of Service ("Terms") form a legal agreement between you and us and govern your access to and use of the platform, including the website, the exam workspace and all related features (together, the "Service").

By creating an account or using the Service you confirm that you accept these Terms. If you do not agree, you must not use the Service.

2.Eligibility and your account

You must be at least 16 years old and able to form a binding contract to use the Service. If you use the Service on behalf of an organisation (for example a tuition provider), you confirm you are authorised to bind that organisation to these Terms.

You are responsible for keeping your login credentials secure and for all activity that occurs under your account. You must give accurate account information and keep it up to date. Notify us promptly of any unauthorised use of your account.

3.The Service and AI-generated feedback

The Service uses artificial intelligence to grade your answers against marking guidance and to generate feedback, scores and study analytics. This is a study aid designed to help you learn — it is not the ACCA, is not affiliated with or endorsed by the ACCA, and does not award real ACCA marks, grades or qualifications.

AI grading is provided on a best-efforts basis and may contain errors, omissions or inconsistencies. A mark, band or comment produced by the Service is an estimate for revision purposes only and is not a prediction or guarantee of your performance in any real examination. You should always use official ACCA materials and your tuition provider's guidance as the authoritative source. Where a tutor reviews or overrides a grade, that review reflects the tutor's judgement, not ours.

4.Acceptable use

You agree not to:

  • use the Service for anything unlawful, or in breach of the ACCA's own rules, exam regulations or code of ethics;
  • attempt to manipulate, reverse-engineer, overload or circumvent the grading system, rate limits or security controls, including through prompt injection or automated scraping;
  • resell, sublicense or share your account, or use the Service to build a competing product;
  • upload content that infringes others' rights, is unlawful, or that you do not have the right to submit; or
  • misrepresent AI-generated feedback as official ACCA marking to any third party.

We may suspend or terminate accounts that breach these Terms or that put the Service, other users or our providers at risk.

5.Subscriptions, billing and free trial

Some features require a paid subscription. Prices, billing intervals and any free-trial terms are shown on our pricing page at the time you subscribe. Payments are processed by our payment provider, Stripe; by subscribing you also agree to Stripe's terms.

Paid subscriptions renew automatically at the end of each billing period unless cancelled beforehand. You can cancel at any time and will retain access until the end of the current period. Except where required by law, payments are non-refundable. We may change prices on reasonable notice, which will take effect at your next renewal.

6.Your content

You keep ownership of the answers and other content you submit ("Your Content"). You grant us a limited licence to process, store and transmit Your Content solely to operate and improve the Service — for example, sending your answer to our AI grading provider to produce feedback, and storing your attempts so you can review them and see your analytics.

You are responsible for Your Content and must not include real personal data of third parties, confidential information, or anything you are not permitted to share.

7.Intellectual property

The Service, including its software, design, question rubrics, model answers and other materials we provide, is owned by us or our licensors and is protected by intellectual-property laws. We grant you a personal, non-exclusive, non-transferable licence to use the Service for your own ACCA study (or, for organisations, for your enrolled students) in accordance with these Terms. All rights not expressly granted are reserved.

8.Disclaimers and liability

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we exclude all implied warranties and do not warrant that the Service will be uninterrupted, error-free or that grading will be accurate.

Nothing in these Terms limits liability that cannot be limited by law (such as for death or personal injury caused by negligence, or for fraud). Subject to that, we are not liable for indirect or consequential loss, or for loss arising from your reliance on AI-generated feedback, and our total liability to you in any 12-month period is limited to the amount you paid us for the Service in that period.

9.Suspension and termination

You may stop using the Service and delete your account at any time from your account settings. We may suspend or end your access if you breach these Terms, if required by law, or if we discontinue the Service. On termination your right to use the Service ends; sections that by their nature should survive (such as intellectual property, disclaimers and liability) will continue to apply.

10.Changes to these Terms

We may update these Terms from time to time. If we make material changes we will take reasonable steps to notify you, for example by email or an in-app notice. Continuing to use the Service after changes take effect means you accept the updated Terms.

11.Governing law and contact

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, unless mandatory local law provides otherwise.
